These Terms & Conditions govern your use of the Phukphan website at phukphan.live and describe the basis on which we provide family legal services.   • "Agreement" means these Terms & Conditions together with any engagement letter or service agreement entered into between you and us.
  • "Content" means all text, images, documents, and other material appearing on or accessible through our website.
  • "Service" or "Services" means the family legal services provided by Phukphan, as described on our website and in any engagement documentation.
  • "User" means any person who accesses our website or contacts us with an enquiry, whether or not they subsequently engage our services.
  • "We", "Us", "Our" refers to Phukphan, a family legal practice at 28 Nimmanhaemin Road, Suthep, Chiang Mai 50200, Thailand.
  • "You", "Your" refers to the User or client engaging with our website or services.

2. Acceptance of Terms

By accessing our website or making an enquiry, you confirm that you are at least 18 years of age (or have parental or guardian authority to act), that you have the legal capacity to enter into an agreement, and that you accept these Terms in full. If you do not accept these Terms, please do not use our website or contact us to engage services.

Where you engage our services on behalf of another person, such as a child, you confirm that you have the authority to do so and that you accept these Terms on their behalf.

3. Service Description

Phukphan provides family legal services in Thailand, focused on helping individuals and families navigate sensitive personal matters with care. Our current service offerings include:

  • Confidential First Meeting — an initial private consultation to understand your situation and explain available options.
  • Care and Custody Guidance — considered support in planning fair arrangements for children's care.
  • Full Matter Support — patient representation and assistance throughout a family legal matter.

All services are provided subject to professional obligations, applicable Thai law, and the specific terms of any engagement agreed in writing. Availability may be affected by workload, case complexity, or geographic scope.

4. User Responsibilities

When using our website or engaging our services, you agree to:

  • Provide accurate, complete, and honest information relevant to your matter.
  • Inform us promptly of any changes to your circumstances that may affect your matter.
  • Use our website only for lawful purposes and in a manner that does not infringe the rights of others.
  • Refrain from transmitting any material that is harmful, offensive, or otherwise objectionable.
  • Maintain the confidentiality of any written advice or documents provided to you.

You agree not to use our website or services to pursue any unlawful purpose, to harass or harm any party, or to misrepresent your identity or circumstances.

Documents and advice prepared for you in the course of our engagement remain subject to professional privilege and are provided for your personal use in connection with your matter only.

6. Payment Terms

Our fees are quoted in Thai Baht (฿) and reflect the scope of service selected. Current service fees are:

  • Confidential First Meeting — ฿3,500
  • Care and Custody Guidance — ฿5,700
  • Full Matter Support — ฿7,800

Fees are payable in accordance with the payment arrangements set out in your engagement letter. We accept payment by bank transfer and other methods confirmed at the time of engagement. Where a matter extends beyond the initial scope, any additional fees will be discussed and agreed with you in advance.

Refund eligibility depends on the stage of work completed. If you have concerns about fees or charges, please contact us to discuss; we will address these with care.

7. Engagement Terms

Legal services are provided on the basis of a written engagement agreed between you and us before work commences. The engagement will describe the scope of the matter, the applicable fee, and the terms under which we act. We will explain the process clearly at the outset so that you are comfortable with what to expect.

The scope of any engagement is limited to the matter described. If your situation changes or new matters arise, these will require a separate discussion and, where appropriate, a revised or new engagement.

8. Confidentiality

We treat all information shared with us as confidential. Information about your matter will not be shared with third parties except where required by law, where you have given your consent, or where it is necessary to advance your matter (for example, with courts or specialist advisors). Professional legal privilege applies to communications between you and our practitioners where those communications are made for the purpose of seeking or giving legal advice. We take care to maintain the integrity of that privilege throughout your matter.

9. Disclaimers

Our website is provided for general information only. Content on this website does not constitute legal advice and should not be relied upon as such. Each family situation is different, and outcomes depend on many factors that cannot be assessed without a proper understanding of your individual circumstances.

We do not make any assurances about particular results in any matter. Legal proceedings and negotiations involve variables outside our control, and while we will always act with care and diligence on your behalf, the outcome of any matter cannot be promised in advance.

Our website is provided "as available" and we do not warrant that it will be uninterrupted or error-free.

10. Limitation of Liability

To the fullest extent permitted by applicable Thai law, our total liability to you in connection with services provided shall not exceed the fees paid by you for the specific matter giving rise to the claim.

We are not liable for any indirect, consequential, or incidental loss arising from your use of our website or from your engagement with our services, except where such liability cannot be excluded by law.

Nothing in these Terms limits or excludes any liability that cannot lawfully be excluded under Thai law, including liability for fraud or gross negligence.

11. Indemnification

You agree to indemnify and hold Phukphan and its practitioners harmless from any claims, losses, costs, or liabilities (including reasonable legal costs) arising from your breach of these Terms, your misuse of our website, or any inaccurate or incomplete information provided by you in connection with a matter.

12. Termination

Either party may bring an engagement to a close at any time, subject to any notice provisions set out in the engagement letter. Upon termination, any fees for work completed up to that point will remain payable. We may also cease to act if required to do so under professional obligations.

Provisions of these Terms that by their nature survive termination — including those relating to intellectual property, confidentiality, disclaimers, and limitation of liability — will continue to apply after any engagement ends.

13. Dispute Resolution

If you have a concern about our services, we ask that you first raise it with us directly. We take all feedback seriously and will endeavour to address concerns promptly and considerately. Most concerns can be resolved informally through open communication.

These Terms are governed by and construed in accordance with the laws of Thailand. Any dispute that cannot be resolved informally will be subject to the jurisdiction of the courts of Chiang Mai, Thailand.

14. General Provisions

  • Entire Agreement: These Terms, together with your engagement letter, form the complete agreement between you and us regarding the subject matter hereof.
  • Severability: If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary, and the remainder of the Terms will continue in full force.
  • Waiver: Failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other right.
  • Assignment: You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our obligations to a suitably qualified successor practice.
  • Notices: Notices under these Terms should be sent by email to [email protected] or by post to our Chiang Mai address.

15. Changes to Terms

We may update these Terms from time to time to reflect changes in our services, applicable law, or professional requirements. When we do, the "Last updated" date at the top of this page will be revised. Continued use of our website or services after any update constitutes acceptance of the revised Terms.
